Terms and Conditions of Use

Gamesa Corporación Tecnológica, (herein after referred to as "Gamesa") offers access to the www.enertron.net website under the terms and conditions of use set forth hereunder:

 

Users

Access to the www.enertron.net website confers upon whomever may do so the condition of USER and expresses the USER'S full acceptance and without reservations of all these TERMS AND CONDITIONS OF USE.

The www.enertron.net website provides the USER with varied information placed at his/her disposal by Gamesa or by third-party service providers. The provision of the Portal's service is free of charge. Notwithstanding the foregoing, Gamesa reserves the right to restrict access to some services subject to the USER'S prior registration by means of completing the USER Registration Form, which is placed at the disposal of whoever may wish to register as a REGISTERED USER.

 

Registering for Services as a Registered User

Registering as a REGISTERED USER of www.enertron.net will be necessary in order to access specific services. Any data provided in the Registration Form are provided freely and voluntarily, so that such data must be true and in keeping with reality.

 

Personal Data Protection

Gamesa guaranties the security and confidentially of the data provided by each USER pursuant to the provisions laid down by Organic Law 15/1999 of December 13 on the Protection of Personal Data (Ley Orgánica 15/1999, de 13 de Diciembre, de Protección de Datos de Carácter Personal) and in keeping with the commitment arising from the application of its Privacy Policy.

 

Intellectual and Industrial Property

Any intellectual and industrial property rights contained in the pages of www.enertron.net, its graphic design and computer codes, along with any trade names, trademarks and logos contained therein are owned by Gamesa, except where otherwise indicated.
Any reproduction, distribution, commercialization or transformation of contents that has not been expressly authorized by their owners constitutes a breach of intellectual and industrial property rights protected by the Law.

 

Contents and Appropriate Use

Gamesa guarantees that all the contents and services offered on www.enertron.net comply with respecting the principle of people's dignity, the principle of non-discrimination due to race, sex, religion, opinion, national origin, incapacity or due to any other personal or social reason, as well as with the principle of protecting youths and infants.
Furthermore, the USER shall undertake to make good use of the contents and services available on www.enertron.net, which may never be used for illegal activities or any that could go against public order, national defense or public health. Any use made by the USER of the contents and services shall have to comply with the principles set forth in the foregoing paragraph.

The pages of www.enertron.net provide links to other third-party contents and the only aim of these links is to provide the USER with the possibility of complementing information through such links. Gamesa shall under no circumstances be held liable for the results that may arise from the USER accessing said links.

 

Exclusion of Guaranties and Liabilities

Access to and the use of the pages of www.enertron.net is done at the USER'S sole and exclusive liability.GAMESA does not guaranty nor shall it be held liable for damages of any kind that may arise from the following circumstances:

• The lack of continuity in the service of www.enertron.net, as well as concerning the incorrect functioning of the web pages.
• The lack of usefulness, appropriateness or validity of the services and contents offered on www.enertron.net, as regards the expectations placed on them by the USER.
• The existence of viruses or programs in the USER'S computer or due to the presence of a virus in the services provided by third parties through www.enertron.net.

 

Jurisdiction and Governing Law 

These Terms and Conditions of Use shall be governed by Spanish legislation. Should any discrepancy or dispute arise concerning the interpretation or application of these Terms and Conditions of Use, both Gamesa and the USER shall expressly waive any jurisdictional privileges they may enjoy and submit themselves to the Courts holding jurisdiction over the USER'S address.Should the USER'S address be outside the borders of Spain, Gamesa and the USER shall expressly waive any kind of jurisdictional privileges they may enjoy and submit themselves of the Courts of the city of Vitoria, Spain.
